1. Description of Service
DivAgent (collectively "divagent.ai", "app.divagent.ai", "we", "us", "the Platform") provides an opinionated dividend auditing and portfolio tracking software tool. The Platform provides mathematical heuristics, risk classifications (the "Risk Spectrum"), and historical data visualization intended for informational purposes only.
2. No Financial Advice
DivAgent is NOT a registered investment advisor (RIA), fiduciary, or broker-dealer.
You understand that no content published on the Platform constitutes a recommendation that any particular security, portfolio of securities, transaction, or investment strategy is suitable for any specific person. You further understand that none of the information providers or their affiliates will advise you personally concerning the nature, potential, value or suitability of any particular security, portfolio of securities, transaction, investment strategy or other matter.
3. Data Accuracy & Reliability
Data provided on the Platform is sourced from third-party APIs (e.g., Yahoo Finance). We do not warrant the accuracy, timeliness, or completeness of such data. You should verify all dividend dates, payout amounts, and share prices independently with official corporate filings (SEC) before making investment decisions.
4. AI-Generated Content
The Platform utilizes Artificial Intelligence (AI) to generate certain content, analysis, and text. You acknowledge that AI-generated content may contain errors, hallucinations, or inaccuracies. DivAgent assumes no liability for the correctness of any AI-generated information.
5. The "Risk Spectrum" & Forecasts
Our Risk Spectrum (Tiers 1-5) and dividend forecasts are proprietary estimates based on historical trends. They are NOT guarantees of future performance. High-yield assets carry substantial risk of principal loss (NAV Erosion). You acknowledge that "Tier 5" assets are extremely speculative.
6. User Responsibilities
You are solely responsible for:
- The confidentiality of your account credentials.
- All investment decisions made using data found on the Platform.
- Reporting and paying taxes on any dividend income generated by your portfolio.
7. Subscriptions & Payments
DivAgent uses Stripe for payment processing. By subscribing to a Premium or Pro plan, you agree to Stripe's terms and authorize us to charge your payment method on a recurring basis. All fees are non-refundable unless required by law.
8. Limitation of Liability
IN NO EVENT SHALL DIVAGENT, ITS EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA OR PROFIT, OR DUE TO BUSINESS INTERRUPTION) ARISING OUT OF THE USE OR INABILITY TO USE THE MATERIALS ON THE PLATFORM, OR FOR ANY ERRORS OR OMISSIONS IN CONTENT WHETHER HUMAN OR AI-GENERATED, EVEN IF WE HAVE BEEN NOTIFIED OF THE POSSIBILITY OF SUCH DAMAGE.
